Website and Account Terms of Use

1. Purpose

These terms govern the use of the website www.monde-singulier.com (the "Website") and of the MS Pro account, published by MONDE SINGULIER, a French simplified joint stock company (SAS) with a share capital of €3,570.80, registered with the Paris Trade and Companies Register under number 912 338 431, whose registered office is at 73 rue du Faubourg Poissonnière, 75009 Paris, France ("Monde Singulier"). Purchases are governed by the General Terms of Sale (for Professional Buyers or for Consumers), which prevail over these terms for anything relating to a sale.

2. Access to the Website

Access to the Website is free of charge; connection costs remain your responsibility. We use our best efforts to keep the Website available, without guaranteeing continuous access: it may be interrupted for maintenance, updates or technical reasons. The prices and availability displayed may change; only an accepted quotation or a confirmed order is binding.

3. The MS Pro account

3.1. Reserved for professionals. The MS Pro account is intended for interior and design professionals (interior designers, decorators, architects, hospitality professionals, property developers, brands and resellers). There is no open registration: you submit an application (MS Pro page), our team checks your professional activity and creates the account. We may refuse an application without giving reasons.

3.2. Activation. You receive a link to choose your password and activate the account. The link expires; a new link can be requested from the Website.

3.3. What the account lets you do: view professional prices, including your discount; order on the Website on professional terms; create projects and rooms, and add products and collaborators to them; prepare estimates and quotations; save favourites.

3.4. Your discount. The account may show a professional discount specific to your account. Prices shown after discount are given for information only; only an accepted quotation or a confirmed order sets the price. Monde Singulier may change the discount of an account for the future.

3.5. Professional status. By using the account to place orders, you declare that you are acting for the purposes of your professional activity; the General Terms of Sale for Professional Buyers then apply. If you are buying for yourself as a private individual, please contact us: the General Terms of Sale for Consumers will apply.

3.6. Security. Your login details are personal and confidential. Any action carried out from your account is deemed to have been carried out by you. Notify us without delay at contact@monde-singulier.com of any unauthorised use.

3.7. Quotations shared by link. A quotation in your project space can be shared by a link: anyone who has this link can view it. Only send it to the people concerned. The prices and terms it contains are confidential (Article 20 of the General Terms of Sale for Professional Buyers).

3.8. Collaborators. You may invite collaborators to a project; you make sure they are authorised to access it and you inform them of the processing of their data.

4. Term, suspension and closure of the account

4.1. The account is opened for an indefinite period.

4.2. You may ask at any time for your account to be closed at once, as soon as no order is under way and no payment is due, by email to contact@monde-singulier.com or through your sales contact. Orders already placed remain governed by the General Terms of Sale; data is kept as set out in the Privacy Policy.

4.3. If you do not use your account for three years (no sign-in, order, cart, request, quotation or project), we close it. We email you thirty days before, then seven days before: simply signing in keeps your account. An account is not closed while an order is under way, a payment is still due or a sales discussion with us is open. What happens to the account on closure is described in section 4 of the Privacy Policy.

4.4. Monde Singulier may suspend or close an account, after informing you, in the event of a breach of these terms, fraudulent use, loss of professional status, disclosure of professional prices to third parties outside a project, or non-payment.

5. Rules of use

You undertake not to: use the Website for unlawful purposes; extract by automated means or reuse the content, prices or databases of the Website; circumvent security measures; send unlawful content, or content infringing the rights of third parties, through the forms; impersonate a third party.

6. Intellectual property

The content of the Website (texts, photographs, visuals, product sheets, downloadable presentations, trademarks, logos, database) is protected. The works presented and their visuals belong to their designers and/or to Monde Singulier. Product sheets and presentations downloaded from the account may be used only to present the pieces to your own client, in the context of the project concerned, crediting the designer and Monde Singulier (Article 19 of the General Terms of Sale for Professional Buyers). Any other reproduction is prohibited without written authorisation.

7. Content you send us

The information you enter (projects, requests, messages, plans, photos) remains yours. You authorise us to use it to handle your request and perform your orders, including by passing it on to the designers and carriers concerned. You warrant that you have the right to send it to us.

8. Liability

Monde Singulier is not liable for damage resulting from an interruption of the Website, from improper use of the account, or from the content of third-party websites to which links point. Nothing in these terms limits Monde Singulier's liability where the law prohibits it, nor the rights you hold under the General Terms of Sale.

9. Reporting unlawful content

You may report any unlawful content on the Website to contact@monde-singulier.com, stating the address of the page, the content concerned and the reasons for your report.

11. Changes

We may change these terms; the new version applies as soon as it is published online. Significant changes affecting the account are notified to you by email.

12. Governing law

These terms are governed by French law. For a consumer, this choice does not deprive them of the protection of the mandatory provisions of the law of their country of residence. Disputes between professionals fall under the courts designated in the General Terms of Sale for Professional Buyers.
